Alyne App – Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Alyne mobile application and any related services (collectively, the "Service"). By installing, accessing, or using Alyne, you agree to be bound by these Terms. If you do not agree, do not use the Service.

"Alyne", "we", "us", or "our" refers to the owner and operator of the Alyne app. "You" or "user" refers to anyone who accesses or uses the Service.

1. Eligibility

You must be at least 13 years old, or the minimum age of digital consent in your jurisdiction, to use the Service. By using Alyne, you represent and warrant that you meet this requirement and that you have the authority to agree to these Terms.

2. Your Acceptance of These Terms

By installing, accessing, or using Alyne, you agree to be bound by these Terms and our Privacy Policy (if presented within the app or linked separately). If you do not agree, you must uninstall the app and discontinue use of the Service.

3. License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use Alyne on a device that you own or control, solely for your personal, non-commercial use, unless otherwise expressly authorized.

You agree not to:

• Reverse engineer, modify, or create derivative works based on the Service.
• Distribute, sell, lease, or sublicense the Service to any third party.
• Remove or alter any proprietary notices or labels contained in the Service.

4. User Accounts and Authentication

Alyne may allow or require you to create an account or sign in using a third-party provider (such as Google or Facebook). You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You agree to:

• Provide accurate and up-to-date information when creating or managing your account.
• Notify us promptly of any unauthorized use of your account or security breach.

5. Ride Data, Location Data, and Safety

Alyne may use GPS and other sensors to record your rides, activities, routes, elevation, speed, and related data. By using the Service, you consent to the collection and use of this data as described in our Privacy Policy.

You are solely responsible for your own safety while using Alyne. You agree that you will:

• Obey all traffic laws, trail rules, and safety regulations while riding.
• Use the Service in a way that does not distract you from safely operating your bicycle or vehicle.
• Not rely on the Service as a substitute for your own judgment or local conditions.

The maps, routes, and statistics provided by Alyne are for informational purposes only and may not be accurate, complete, or up to date. Terrain, conditions, and accessibility can change without notice.

6. Third-Party Services

The Service may integrate with or rely on third-party services, including but not limited to: authentication providers (Google, Facebook), map providers, analytics services, and cloud storage providers.

Your use of these third-party services may be subject to their own terms and privacy policies. We are not responsible for the content, policies, or practices of third-party services.

7. Acceptable Use

You agree that you will not use the Service to:

• Violate any applicable law, regulation, or third-party rights.
• Upload or transmit any content that is unlawful, harmful, abusive, defamatory, or otherwise objectionable.
• Attempt to gain unauthorized access to the Service or to other users' accounts or data.
• Interfere with or disrupt the operation of the Service or servers or networks connected to the Service.
• Use the Service to develop or train competing services without our permission.

8. Intellectual Property

The Service, including its design, text, graphics, logos, icons, and software, is owned by the Alyne owner or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You retain ownership of your own ride data and content that you create using the Service. By using the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to store, process, and display your data solely for the purpose of operating and improving the Service.

9. In-App Purchases and Fees

Alyne may be offered as a free or paid service and may include optional in-app purchases or subscriptions in the future. Any fees, pricing, or payment terms will be presented to you within the app store or the Service. Unless required by law or stated otherwise, purchases are final and non-refundable.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that any data or content will be accurate or reliable. Use of the Service is at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT, IF ANY, THAT YOU PAID TO USE THE SERVICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless the Alyne owner and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if we decide to discontinue the Service. Upon termination, your right to use the Service will immediately cease.

You may stop using the Service at any time by uninstalling the app and, where applicable, requesting deletion of your data.

14. Changes to the Service and Terms

We may update, modify, or discontinue the Service at any time, with or without notice. We may also update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page.

Your continued use of the Service after any changes to the Terms constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Alyne owner is based, without regard to its conflict of law principles. You agree that any disputes arising out of or relating to the Service or these Terms will be subject to the exclusive jurisdiction of the courts in that jurisdiction.
